Terms and Conditions

7.1 Treasury Ownership

All project treasuries created within the Futarchy402 system are owned and controlled by Futarchy402. Project creators do not have direct ownership or control over treasury funds or assets.

7.2 Transaction Rights

Project creators have the right to request transactions from their associated treasuries through the governance mechanism provided by the platform (proposals and community polls). All treasury transactions must be conducted through this official process, unless an explicit request has been made to and approved by the Futarchy402 team.

7.3 Treasury Freezing and Abandonment

Futarchy402 reserves the right, at its sole discretion and upon reasonable suspicion of any of the following, to immediately freeze treasury funds and mark the associated project as "abandoned":

• Illicit activities related to the project or its creators
• Market manipulation or fraudulent poll activity
• Ill intent regarding the project, its associated products, or entities
• Violation of any terms outlined in this agreement
• Activities that pose legal, regulatory, or reputational risk to Futarchy402

Once a treasury is marked as "abandoned," the project creator loses all rights to request transactions or access treasury funds. This decision is final and at the sole discretion of Futarchy402.

8.1 Current Fee Structure

• Poll Creation Fee: 0.1 SOL per proposal/poll created
• Platform Fee: 3% of transaction fees and creator rewards claimed from project tokens

8.2 Fee Payment

All fees are automatically deducted from the relevant transactions or treasury operations. Fees are non-refundable under any circumstances.

12.1 No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12.2 Not Financial Advice

Nothing on this platform constitutes financial, investment, legal, or tax advice. You should consult with appropriate professionals before making any financial decisions.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

20.1 User-Generated Content

All content uploaded to the platform, including but not limited to project images, descriptions, names, social media links, and proposal information, is uploaded and provided by users. By uploading content, you represent and warrant that you have all necessary rights to such content and that it does not violate any third-party rights or applicable laws.

20.2 Content Ownership and License

You retain ownership of content you upload. However, by uploading content to Futarchy402, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and promoting the platform.

20.3 Content Moderation

We reserve the right, but not the obligation, to monitor, review, and remove any user content at our sole discretion if we detect or suspect:

• Violations of these Terms or applicable laws
• Offensive, harmful, or inappropriate content
• Fraudulent, misleading, or deceptive information
• Copyright or trademark infringement
• Content that poses risk to users or the platform

Important: We make reasonable efforts to moderate content, but due to the decentralized nature of blockchain technology and system limitations, we cannot guarantee that all content will be reviewed or moderated. Users access and rely on platform content at their own risk.

21.1 Termination Rights

Futarchy402 reserves the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Market manipulation or abuse
• Risk to platform security or integrity
• Extended period of inactivity

21.2 Effect of Termination

Upon termination or suspension, your right to access and use the platform immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability. Blockchain transactions completed prior to termination remain immutable and cannot be reversed.

21.3 User-Initiated Termination

You may cease using the platform at any time by disconnecting your wallet. However, this does not affect any obligations or liabilities incurred prior to termination, and on-chain transactions remain permanent.

23.1 Export Control Laws

You agree to comply with all applicable export control and sanctions laws, including those administered by the U.S. Department of Treasury's Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce, and similar authorities in other jurisdictions.

23.2 Prohibited Jurisdictions

You may not use the platform if you are located in, or a resident of, any jurisdiction where the use of cryptocurrency platforms or prediction markets is prohibited or restricted, including but not limited to:

• Countries subject to comprehensive OFAC sanctions (including Cuba, Iran, North Korea, Syria, Russia, and the Crimea region)
• Any jurisdiction where your use would violate applicable law

23.3 Sanctions Screening

We reserve the right to implement wallet screening and block access to users from sanctioned jurisdictions or those appearing on sanctions lists. We may suspend or terminate accounts that violate sanctions laws.

24.1 Compliance Obligations

Futarchy402 is committed to preventing money laundering and terrorist financing. We reserve the right to implement AML and KYC procedures as required by applicable laws and regulations.

24.2 Identity Verification

We may, at our sole discretion and without prior notice, require identity verification before allowing certain activities, including:

• Large treasury withdrawals or transactions
• Suspicious activity patterns
• Compliance with regulatory requirements

Failure to provide requested information may result in suspension or termination of platform access and freezing of associated treasuries.

24.3 Suspicious Activity Reporting

We reserve the right to report suspicious transactions or activities to relevant authorities as required by law, without notifying the user.

25.1 No Endorsement

These links are provided for convenience only. We do not endorse, verify, or assume responsibility for any third-party content, products, services, or websites. Links provided by project creators are their sole responsibility.

25.2 Third-Party Risks

You access third-party links at your own risk. We are not liable for any damages, losses, or issues arising from your use of third-party services. You should review the terms and privacy policies of any third-party services you access.
